Abstract

This study examines illocutionary force in the Saudi Anti-Cyber Crime Law. It aims to identify patterns of illocutionary force in the provisions of the Law, analyze the key linguistic and contextual indicators that contribute to its determination, and demonstrate the diversity of functions performed by the Law’s provisions in light of their illocutionary force. The study adopts a descriptive-analytical approach, drawing on speech act theory to explain the concept of illocutionary force and analyze its patterns in the Law’s provisions. The findings reveal three main patterns of illocutionary force: foundational, penal, and regulatory. They also show that illocutionary force is not determined by a single indicator; rather, it emerges from the interaction of several elements, foremost among which is the illocutionary point, alongside linguistic forms, constructions, contextual constraints, and the legal context. The analysis further demonstrates that the severity of the penalty and the limits of discretionary authority do not determine illocutionary force; instead, they relate to the content of the ruling and its application. The study recommends examining illocutionary force in judicial precedents concerning cybercrimes to identify its patterns and the ways in which it is realized in the context of judicial application.

تتناول هذه الدراسة القوّّة الإنجازيّّة في نظام مكافحة جرائم المعلوماتيّّة السُُّعوديّّ؛ بهدف الكشف عن أنماطها في مواد النّّظام، وتحليل أبرز المؤشرات اللغوية والسِّّياقيّّة التي تسهم في تحديدها، وبيان تنوع الوظائف التي تؤدّّيها مواد النّّظام في ضوء قوتها الإنجازيّّة. واعتمدت ا لمنهج الوصفي التّّحليليّّ، مستفيدة مِِن نظريّّة أفعال الكلام في عرض مفهوم القوّّة الإنجازيّّة وتحليل أنماطها في مواد النّّظام. وقد كشفت الدراسة عن ثلاثة أنماط رئيسة للقوّّة الإنجازيّّة: المؤ سِسِّة، والجزائيّّة، والتنظيميّّة. وأظهرت أنََّ القوّّة الإنجازيّّة لا تتحدد بمؤ رشِّر منفرد، وإنما تتشكل مِِن تضافر مجموعة مِِن العناصر، يأتي الغرض الإنجازيّّ في مقدّّمتها، إلى جانب الصيغ والتراكيب والقيود المصاحبة والسّّياق النّّظامي. وب ن يّن التحليل أنََّ مقدار الجزاء وحدود السُُّلطة التقديريّّة لا يحددان القوّّة الإنجازيّّة، وإنما يتصلان بمضمون الحُُكم وكيفية تطبيقه. وأوصت بدراسة القوّّة الإنجازيّّة في السوابق القضائيّّة المتعلّّقة بجرائم المعلوماتيّّة؛ للكشف عن أنماطها وكيفية تحقّّقها في سياق التطبيق القضائيّّ.
